Actions Taken by the Georgia State Board of Registration of Used Motor Vehicle Dealers at its April 23 Meeting

Macon, Ga. (April 29, 2008) — The Georgia State Board of Registration of Used Motor Vehicle Dealers held a public hearing on Wednesday, April 23, 2008 to provide licensees an opportunity to appeal their inspection citations.

   The Board voted to adopt a policy to accept all Voluntary Cease and Desist Orders upon receipt and authorize the chairperson or his or her designee to execute the Order, and to authorize that the Orders be docketed and served. It is the intent of the Board that the Orders will be in effect upon docketing. The Board will ratify the docketed Cease and Desist Orders at its next meeting and include a list of the approved Orders in the Board minutes.

   The Board voted to issue final decisions on each of the following cases:

     Auto Works, Augusta: Fines totaled $3,125.
   A $2,375 fine for 19 instances of failure to properly provide information on posted FTC Buyer's Guides on each vehicle offered for sale.
A $250 fine for three failures to post FTC Buyer's Guides on each vehicle offered for sale.

     B & M Motors, LLC, Cartersville: A $500 fine for one instance of failure to furnish appropriate documents required for tag transfer to the retail purchaser within 30 days of purchase date.

     Heaven Sent Autos LLC, Fairburn: Within 10 days of receipt of the Final Decision, Heaven Sent Autos is to submit proof to the Board that it has demanded in the form of a certified letter that the consumer return the vehicle to the company in exchange for a refund of money paid by consumer.

     Hwy 92 Auto Sales, Acworth: A $1,250 fine for five instances of failure to post FTC Buyer's Guides on each vehicle offered for sale.

     Loganville Auto Sales, Loganville: Fines totaled $1,750.
A $1,000 fine for one instance of failure to apply for a title in the retail purchaser's name within 30 calendar days after the date of sale, and one instances of failure to furnish appropriate documents required for tag transfer to the retail purchaser within 30 days of purchase date.
A $750 fine for three instances of failure to post FTC Buyer's Guides on each vehicle offered for sale.

     Raymond Smith Motorcars, Inc., Rome: An $89,000 fine for 89 instances of failure to apply for a title in the retail purchaser's name within 30 calendar days after the date of sale, and 89 instances of failure to furnish appropriate documents required for tag transfer to the retail purchaser within 30 days of purchase date.

     Robinson Automotive Group, Marietta: A $1,000 fine for one instance of failure to apply for a title in the retail purchaser's name within 30 calendar days after the date of sale, and one instance of failure to furnish appropriate documents required for tag transfer to the retail purchaser within 30 days of purchase date.

     SmartMove Auto LLC, Roswell Road location, Atlanta: A $2,000 fine for two instances of failure to apply for a title in the retail purchaser's name within 30 calendar days after the date of sale, and two instances of failure to furnish appropriate documents required for tag transfer to the retail purchaser within 30 days of purchase date.

     SmartMove Auto LLC, Decatur: An $8,000 fine for eight instances of failure to apply for a title in the retail purchaser's name within 30 calendar days after the date of sale, and eight instances of failure to furnish appropriate documents required for tag transfer to the retail purchaser within 30 days of purchase date.

     SmartMove Auto LLC, Doraville: A $3,000 fine for three instances of failure apply for a title in the retail purchaser's name within 30 calendar days after the date of sale, and three instances of failure to furnish appropriate documents required for tag transfer to the retail purchaser within 30 days of purchase date.

     SmartMove, Auto LLC, Morrow: Total Fines $9,500.
A $9,000 fine for nine instances of failure to apply for a title in the retail purchaser's name within 30 calendar days after the date of sale, and nine instances of failure to furnish appropriate documents required for tag transfer to the retail purchaser within 30 days of purchase date.
A $500 fine for one instance of failure to check appropriate box on odometer disclosure statement.

     V&V Auto Center, Marietta: A $9,000 fine for nine instances of failure to apply for a title in the retail purchaser's name within 30 calendar days after the date of sale, and nine instances of failure to furnish appropriate documents required for tag transfer to the retail purchaser within 30 days of purchase date.

     The Board voted to accept the Consent Order issued to Auto City, located in Acworth, upon receipt. The Consent Order was issued after the licensee failed to acknowledge a criminal arrest and subsequent First Offender plea on a license renewal application.

   The Georgia State Board of Registration for Used Motor Vehicle Dealers will hold their next meeting on Wednesday, May 21, 2008 at 10 a.m. at the Professional Licensing Boards in Macon.
